We may also refer to [eyewind] team as “We”, “us” or “Our”.

[eyewind] team has adopted this privacy policy ("Privacy Policy") to explain how we collects, stores, and uses the information collected in connection with our Services.

By installing, using, registering to, or otherwise accessing the services, you agree to this privacy and give explicit and informed consent to the processing of your personal data in accordance with this privacy policy. If you do not agree to this privacy policy, please do not install, use, register to, or otherwise access the services.

We reserve the right to modify this Privacy Policy at reasonable times. If we make significant changes to this Privacy Policy, we may post a notice on our website along with the updated Privacy Policy. Your continued use of Services will signify your acceptance of the changes to this Privacy Policy. 

Use of Non-personal Data

For the purposes of this Privacy Policy, “non-personal data” means information that does not directly identify you. The types of non-personal data we may collect and use include, but are not limited to: application properties, including, but not limited to application name, package name, and icon installed on your device. Your check-in (include like, recommendations) of a game will be disclosed to all our users.

The data we collect depends on the context of your interactions with us, the choices you make, including your privacy settings, and the products and features you use. It may include SDK/API/JS code version, browser, Internet service provider, IP address, platform, timestamp, application identifier, application version, application distribution channel (some services also record the list of applications and/or processes that are installed or run on your device) independent deice identifier, iOS ad identifier (IDFA), Android ad master identifier, network card (MAC) address, and international mobile device identification code (IMEI) The equipment model, the terminal manufacturer, the terminal device operating system version, the session start/stop time, the location of the language, the time zone and the network state (Wi-Fi and so on), the hard disk, the CPU, and the battery use, etc.

We may use and disclose the collected non-personal data to our partners and contractors to analyze the use of the service, investigate and prevent unauthorized use of the service or take action to further develop the service and other services and products.

Use of Personal Data

For purposes of this Privacy Policy, “personal data” means personally identifiable information that specifically identifies you as an individual. Personal information collected by [eyewind] is information voluntarily provided to us by you when you create your account or change your account information. The information includes your Facebook ID, name, gender, location, and your friends' ID on Facebook. We also store your game check-ins, likes, dislikes, recommendations, and messages. The personal data and information include:

  • Mobile device's unique identifier (UDID).
  • Email address is used to log in to the social network.
  • Social network or third-party service user identification number (like your Facebook ID number), which is linked to publicly-available information like your name and profile photo (including the social network ID numbers and other public data of your friends).
  • In-game transaction identifiers and purchases.
  • Device type and its OS version.
  • The local language and country settings on your device.
  • The list of applications and/or processes that are installed or run on your device.
  • We may use collected personal data for purposes of analyzing usage of the Services, providing customer and technical support, managing and providing services (including managing advertisement serving), and to further develop the Services and other [eyewind] services and products. Furthermore, we may combine non-personal data with personal data. But unless the Law forces us, we will not share any personal data with any unaffiliated third party for any purpose.

    Please note that certain features of the Services may be able to connect to your social networking sites to obtain additional information about you. In such cases, we may be able to collect certain information from your social networking profile when your social networking site permits it, and when you consent to allow your social networking site to make that information available to us. This information may include, but is not limited to, your name, profile picture, gender, user ID, email address, country, language, time zone, the organizations, and links on your profile page, the names and profile pictures of your social networking site “friends” and other information you have included in your social networking site profile. We may associate and/or combine as well as use information collected by us and/or obtained through such social networking sites in accordance with this Privacy Policy. 

    1. Ad-related information

    The following data might be reported about the ads you can view: the date and time a particular ad is served; a record if that ad was “clicked” or if it was shown as a “conversion” event; what the ad offer is about; what type of ad it is (e.g., text, image, or video); which ad placement is involved (where the ad offer is displayed within the App); whether you respond to the ad.

    2. In-app events

    When you use our App, analytics tools automatically record your activity information (tutorial steps, leveling up, payments, in-app purchases, custom events, progression events, method of limiting the processing of user data).

    3. Payment Information

    Our e-commerce provider (Apple / Google) is responsible for billing, processing, and charging for the in-app purchases, handles your personal information, and keeps it absolutely safe and secure. We cannot access or use your credit or debit card information. You may access the applicable “in-app” purchase rules and policies directly from the app stores.

    4. Disclosure and Transmission

    We collect and process personal data on a voluntary basis. It does not engage in the business of selling your personal data to third parties. However, personal data may sometimes be disclosed in accordance with applicable laws and this privacy policy.

    We may disclose your personal data to third parties at the request of law enforcement agencies or other government officials in order to investigate fraud, intellectual property infringement, or other illegal activities or activities that may make you or us liable.

    When we have reason to believe that it is necessary to disclose your personal data in order to resolve potential or actual harm or interference with our rights, property, operations, users, or others that may be harmed or may suffer loss or damage, or we believe such disclosure It is necessary to protect our rights, combat fraud, and/or comply with the judicial procedures, court orders or legal procedures provided on us. To the extent permitted by applicable laws, we will make reasonable efforts to notify you of such disclosures through our website or other reasonable means.

    In addition, if we participate in a merger, acquisition, or sell part or all of its assets in any form, we will issue a notice before the transfer of personal information and are subject to a different privacy policy.

    According to mandatory legislation and this privacy policy, we may store and/or transfer your personal data to its affiliates and partners in EU/EEA member states and within and outside the United States. We may disclose your personal data to third parties related to company mergers, mergers, reorganizations, sales of almost all we stock and/or assets, or other company changes, including but not limited to during any due diligence process. However, this privacy policy will continue to govern such personal data.

    5. Purpose of Processing Personal Date

    Our mission is to constantly improve our App and provide you with new experiences. As part of this mission, we use your information for the following purposes:

  • To make our service available. We use functional information and information that is processed automatically to provide you with all requested services.
  • To improve, test and monitor the effectiveness of our App. We use the information that is processed automatically to better understand user behavior and trends, detect potential outages and technical issues, to operate, protect, improve, and optimize our App.
  • To provide you with interest-based (behavioral) advertising or other targeted content. We may use the information that is processed automatically for marketing purposes (to show ads that may be of interest to you based on your preferences). We provide personalized content and information to you, which can include online ads or other forms of marketing.
  • To communicate with you. We use the information we have to communicate with you through newsletters, i.e. to send you marketing notifications, receive your feedback about our App experience, and let you know about our policies and terms. We also use your information to respond to you when you contact us.
  • To prevent fraud and spam, to enforce the law. We really want our App to be free of spam and fraudulent content so that you feel safe and free. We may use your information to prevent, detect, and investigate fraud, security breaches, potentially prohibited or illegal activities, protect our trademarks and enforce our Terms of Use.
  • If any new purposes for processing your personal data arise we will let you know we start to process information on that other purpose by introducing the corresponding changes to this Privacy policy.

    6. Legal basis for data processing

    As mentioned above, we process personal data for the purposes specified in this privacy policy. Our legal basis for processing personal data includes the following processing: Necessary to perform the contract with you (for example, to provide you with the services you request and to identify and verify your identity so that you can use the website); Necessary to comply with legal requirements (For example, to comply with applicable accounting rules and make mandatory disclosures to law enforcement agencies); necessary for our legitimate interests (for example, to manage our relationship with you, to ensure the safety of our services, and to communicate with you on our products and services) Communication); and based on the consent of our customers (for example, placing certain cookies and sharing your information with third parties for advertising purposes).

    7. International transfer of personal data

    Our business may require us to transfer your personal data to countries/regions outside the European Economic Area (“EEA”), including countries/regions such as the People’s Republic of China or Singapore. We take appropriate measures to ensure that the recipients of your personal data assume confidentiality obligations, and implement measures such as standard contractual clauses.     Sharing of Information

    We will share your information with third parties only in the ways that are described in this Privacy policy. Please note that while integrating external services, we choose third parties that can assure they apply all necessary technical and organizational measures to protect user personal data. However, we cannot guarantee the security of any information transmitted from us to any such third party. We are not responsible for any accidental loss or unauthorized access to your personal data through a fault of third parties.

    We will not rent or sell your personal data to any third parties, but we may share your information from tools like log files, device identifiers, and location data, with third-party organizations that provide automatic data processing technologies for the App. Furthermore, we do not control or influence these third parties tracking technologies or how they may be used.

    We may also share certain information such as cookie data with third-party advertising partners. This information allows third-party ad networks, inter alia, to deliver targeted advertisements that they believe will be of most interest to you.

    Our App may contain links to third-party websites/services, or you may access the App from a third-party site. We are not responsible for the privacy practices of these third-party sites or services linked to or from our App, including the information or content contained within them.

    We may disclose your personal information if it is needed for objective reasons, due to the public interest, or in other unforeseen circumstances:

    1. As required by law;

    2. When we believe, in good faith, that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;

    3. If we are involved in a merger, acquisition, or sale of all or a portion of our assets, you will be notified via email and/or a prominent notice in our App of any change in ownership or your personal information usage, as well as any choices you may have regarding your personal information.

    2. How to Opt-Out

    a. Opt-out of marketing tracking

    If you don’t want third-party service providers to use to personalize ads on the basis of your interests, please follow the instructions below:

    Choose the option “Opt-out of Ad Personalization” on your Android device in Settings/ Google/ Ads.

    b. Opt-out of Location Data Processing

    If you don’t want third-party service providers to use your precise location data, or street-level location information about you, please follow the instructions below: iOS 11 or later: turn Location Services off for the applicable Product via the menu “Settings > Privacy > Location Services”. Then select the applicable App and set the “Share My Location” status to “Never”. 

    Android 5.0 or later: turn Location off for the applicable Product via the menu “Settings > Apps > [applicable Product] > Permissions > Location”. Then turn off the “Location” button.

    Safeguards

    We follow generally accepted industry standards and maintain reasonable safeguards to attempt to ensure the security, integrity, and privacy of the information in our possession. Only those persons with a need to process your personal data in connection with the fulfillment of their tasks in accordance with the purposes of this Privacy Policy and for the purposes of performing technical maintenance have access to your personal data in our possession. Personal data collected by us is stored in secure operating environments that are not available to the public. To prevent unauthorized online access to personal data, we maintain personal data behind a firewall-protected server. However, no system can be 100% secure and there is the possibility that despite our reasonable efforts, there could be unauthorized access to your personal data. By using the Services, you assume this risk.

    Children's Privacy

    Sometimes, we have some apps for all ages. We consider ourselves to be family-oriented, however, we have decided to voluntarily implement higher child protection standards even though our products and services are not directed to, and we do not knowingly collect personal information from children under 13, with the sole exception of persistent identifiers as described below. If we learn that we have collected personal information other than the persistent identifier of a child under the age of 13, we will take all reasonable steps to delete the information as soon as possible. If you become aware that your child has provided us with personal information without your consent, please contact us at Privacy@eyewind.cc.

    In order to preserve the family-friendly reputation of our Apps, we age-gated some features in our Apps, so that they are not available for use by children under 13. The age gate is being conducted after the download of some of our Apps for specific territories in order to assure the privacy and protection of younger users of our Apps. The features enabling potential collection and sharing of personally identifiable information, except for persistent identifiers, are disabled for device IDs of users who did not pass the age gate. For users’ safety, it is not possible to change the age later on. We do not store the year of birth of users who have identified themselves as below the age of 13 in our Apps, but only the information that their device ID did not pass the age gate.

    The only personal information we collect from users who have identified themselves as below the age of 13 for the purposes of offering our services are persistent identifiers (such as device ID, IDFA, IDFV, advertising ID, IP address). Such persistent identifiers are used and shared with third parties solely for providing support for the internal operations meaning placing contextual advertisements (including frequency capping), authenticating users of or personalize the content on Apps, maintaining or analyzing the functioning of the Apps, personalize the content of the App (such as sending push notifications), to perform network communications to protect the security or integrity of the user or the App, to ensure legal or regulatory compliance.

    When using the persistent identifiers, we will not contact users under the age of 13, display behavioral advertising to them, nor do any user tracking or profiling. In addition, we strive that all of our advertising partners adhere to the same standards for the collection, usage and disclosure of children’s personal information as we do, but we can not be responsible if they breach the commitments they gave to us regarding the collection of information. In case of such breaches, you agree that our liability is limited to the amounts we are able to receive as indemnification for the breaches from our advertising partner.     Access Right

    According to the restrictions of applicable laws, you have the right to object to or request restrictions on the processing of your personal data, and you have the right to request access, correction, deletion and carrying of your own personal data. If the use of your information is based on consent, you can withdraw that consent at any time without affecting the legality of processing based on consent before withdrawal.

    Rectification

    If you know that your information has changed or is inaccurate, you should notify us of such changes so that our records can be updated or corrected. If you believe that our processing of your personal data violates applicable laws, you can file a complaint with a supervisory authority.

    Erasure

    In some cases, you have the right to request that we delete the information we have collected from you. You may access or request deletion of your personal information directly by contacting us at Privacy@eyewind.cc. We will respond to your request within a reasonable timeframe and ask for the information that you need to provide.

    As long as we provide services or products to you, we will retain your personal data, or as required or permitted by applicable laws (such as tax and accounting laws).

    Other

    Please be aware of the open nature of certain social networking and other open features of the Services we may make available to you. You may choose to disclose data about yourself in the course of contributing user-generated content to the Services. Any data that you disclose in any of these forums, blogs, chats, or the like is public information, and there is no expectation of privacy or confidentiality. We are not responsible for any personal data you choose to make public in any of these forums.

    We may store and/or transfer your personal data to its affiliates and partners in and outside of EU/EEA member states and the United States in accordance with mandatory legislation and this Privacy Policy. We may disclose your personal data to third parties in connection with a corporate merger, consolidation, restructuring, the sale of substantially all of our stock and/or assets or other corporate change, including, without limitation, during the course of any due diligence process provided, however, that this Privacy Policy shall continue to govern such personal data.

    We regularly review its compliance with this Privacy Policy. If we receive a formal written complaint from you, it is our policy to attempt to contact you directly to address any of your concerns. We will cooperate with the appropriate governmental authorities, including data protection authorities, to resolve any complaints regarding the collection, use, transfer, or disclosure of personal data that cannot be amicably resolved between you and us.
